Protections for Florida Homeowners After Hurricanes (Live in Florida )

In the aftermath of Hurricane Helene, Florida Governor Ron DeSantis has announced a series of measures aimed at protecting policyholders in the state. The Office of Insurance Regulation (OIR) has issued an emergency order to safeguard consumers and ensure insurers take immediate action to support recovery efforts.

Insurance Commissioner Michael Yaworsky emphasized the commitment to consumer protection, stating, “OIR remains committed to protecting consumers in the aftermath of Hurricane Helene and expects insurers to engage in frequent and meaningful conversation with policyholders throughout the recovery effort.”

Policyholder Protections in the Wake of Hurricane Helene

OIR has issued Emergency Order 400385-24, which applies to all insurers operating in Florida and covers policyholders in several counties affected by the storm. This order provides crucial safeguards, including:

1. Extension of Grace Periods: Any policy provision, notice, or law that imposes a time limit on an insured party’s actions is extended until November 26, 2024.

2. Prohibition of Cancellations and Nonrenewals: Insurers are prohibited from canceling or not renewing policies in affected areas until November 26, 2024, unless the policyholder submits a written request.

3.Protection for Repaired Properties: Policies covering homes or commercial properties repaired due to damage from Hurricane Helene cannot be canceled or nonrenewed for a period of 90 days after repairs have been completed.

4. Claims Payment Procedures: Insurers are directed to implement streamlined processes to facilitate the efficient payment of claims.

These protections ensure that Florida homeowners, especially those in the hardest-hit areas, have the support they need to recover from the storm without additional financial strain.

Counties Covered Under the Emergency Order

The emergency order covers policyholders in the following counties: Alachua, Charlotte, Citrus, Columbia, Dixie, Gadsden, Gilchrist, Gulf, Franklin, Hamilton, Hernando, Hillsborough, Jefferson, Lafayette, Lee, Leon, Levy, Liberty, Madison, Manatee, Pasco, Pinellas, Sarasota, Suwannee, Taylor, and Wakulla.
